E-Waste Rules 2022

Secure ITEW Decommissioning & EPR Fulfillment

Guaranteed Data Destruction and Green Certificate issuance for Servers, Routers, and Smart Phones. Zero-landfill compliance aligned with CPCB Centralized EPR Portal.

The Kabadiwala Violation

Selling ITEW to informal scrap dealers breaches EPR mandates. As a Bulk Consumer, you must channel e-waste ONLY to registered recyclers to avoid legal penalties.

Technical Scope

Information Technology & Telecom Equipment

Designated as Schedule I (ITEW) under the 2022 Rules. These assets contain high-value precious metals (Gold, Palladium) alongside hazardous constituents (Lead, Mercury) requiring rigorous segregation and data security.

Regulatory Classification

CODE ITEW

E-Waste Rules, 2022

Information Technology and Telecommunication Waste.

HAZARD

Constituents

Batteries (Li-ion/Lead), PCBs (Lead), Mercury (Backlighting).

Computing

Mainframes, Servers, Personal Computers (CPU), Laptops, Notebooks, Tablets.

Networking

Routers, Switches, Modems, Wi-Fi devices.

Peripherals

Printers (incl. cartridges), Scanners, Copying Equipment, User Terminals.

Communication

Smart Phones, Feature Phones, Cordless Telephones, Fax Machines.

Regulatory Tripwires

Governed by E-Waste (Management) Rules, 2022.

Kabadiwala Violation

Selling ITEW to informal dealers is illegal. As a Bulk Consumer, you must channel e-waste only to registered recyclers.

EPR Credit Loss

Recycling generates tradeable EPR Certificates. Leaking waste to the informal sector means losing credits needed to meet producer targets.

Data Breach Liability

Improper disposal leading to data leakage attracts penalties under the IT Act, 2000, plus environmental fines.

LITHIUM-ION RISKS

Laptops/phones contain Li-ion batteries (Class 9). Unauthorized dismantling can cause thermal runaway and fires.

TONER HAZARDS

Cartridge toner powder is combustible and a respiratory hazard. Do not crush in standard compactors.

STORAGE LIMIT

Rule 24 mandates max storage of 180 days. Storage must be weatherproof with impermeable flooring.

The KLIN ENVIRO Protocol

Secure Logistics, Data Destruction, and Green Certification

1

Secure Collection

  • GPS-tracked, closed-container vehicles.
  • Sealed cages for high-value data assets (Servers).
2

Documentation

  • Form 6 / Manifest: Documented custody transfer.
  • EPR Credit Gen: Upload to CPCB portal for tradable credits.
3

Authorized Treatment

DATA DESTRUCTION

Degaussing & Shredding + Certificate of Destruction.

RECOVERY

PCB precious metal recovery (Hydrometallurgy).

Technical FAQs

Can we sell our old laptops to employees or local charities?

If functional, yes (receiver becomes new 'user'). If end-of-life (non-functional), it MUST go to a registered recycler. Selling e-waste to unregistered entities is illegal under E-Waste Rules 2022.

How do I prove I have met my 'Bulk Consumer' obligations?

You must file an Annual Return (Form 3) to the SPCB by June 30th. This must tally with records of e-waste handed over to authorized recyclers (manifests/certificates).

What happens to the data on our copier hard drives?

Modern copiers store image data on hard drives. We treat these devices as IT assets, performing data wiping or physical destruction of the drive before the machine is recycled.

Are printer cartridges considered E-Waste or Hazardous Waste?

They fall under E-Waste (ITEW peripherals). However, toner powder is hazardous. We dismantle cartridges in controlled environments to capture dust, preventing pollution.

How does the 2022 amendment affect our disposal costs?

It created a market for EPR Certificates. While you pay for logistics/data destruction, the intrinsic metal value and tradeable EPR credits often offset these costs.
